SHIMMER AND DELIGHTS SERVICE AGREEMENT & DISCLAIMER

By booking with Shimmer and Delights, you (the “Client”) agree to the following terms:

1. Services Provided

We provide candy and dessert tablescapes, as well as charcuterie and grazing tables for weddings and events. Our dessert table setup will be available for up to 4 hours at the event location.

2. Food and Allergy Disclaimer

• Our desserts are made using chocolate melts that may contain peanut oil or other allergens.

• Items used for our charcuterie tables are primarily store-bought, with flavor enhancements added.

• It is the Client’s responsibility to notify guests of any potential allergens. We are not liable for allergic reactions or food sensitivities.

3. Cottage Food Notice

Our desserts are produced under Florida’s Cottage Food Law, which allows for the preparation of certain foods in a non-commercial kitchen. By booking, the Client acknowledges this and waives any claims regarding kitchen standards. These foods are not inspected by the Florida Department of Agriculture and Consumer Services.

4. Liability

The Client releases Shimmer and Delights from any liability, and shall defend, indemnify and hold Shimmer and Delights harmless from any claims related to:

• Food allergies or adverse reactions

• Foodborne illness

• Accidents or injuries related to the food or display

5. Payment and Cancellation

• Full payment is required 45 days prior to the event or by a date agreed upon by both parties.

• If the event is booked less than 45 days prior to the event date, full payment is required at the time of booking.

• Cancellations made more than 45 days before the event will receive a full refund, minus deposit.

• Cancellations made within 45 days of the event will incur a 50% cancellation fee.

6. Rescheduling Due to Unforeseen Circumstances

In the event of a death in the family, or a natural disaster such as a storm, hurricane, or fire, the Client will not lose their deposit or payment. The Client may reschedule the event within one year of the original event date at no additional cost, subject to availability.

7. Media and Photography Agreement

Shimmer and Delights requests to be included in the photographers’ and/or videographers’ shared photo dropbox or equivalent photo-sharing platform used for the event. This will allow us to access professional images of our setups. Any images used on Shimmer and Delights’ social media or promotional materials will properly credit the photographer or videographer.

8. Florida Law

This Agreement is governed by Florida law. Any disputes will be handled in the courts of Pasco County, Florida. In any dispute, the prevailing party shall be entitled to an award of its attorneys’ fees and costs from the non—prevailing party.
